Mobil App Privacy Policy

Mobil Oil Guam, Inc and Mobil Oil Mariana Islands Inc. and its affiliated companies ("Mobil" or "we", "us", or "our") are pleased to give you access to the Mobil application along with related or linked websites, applications, services, interfaces, tools, software, and other functionality provided on or through the Mobil application (collectively the "Mobil App"), subject to the Mobil App Terms and Conditions and this Privacy Policy.

Our Commitment to you. Your privacy is important, and we want you to understand our practices with respect to gathering information from Mobil App users and the uses we make of that information. The Mobil App was developed by Mobil as the Data Controller to support the Smiles Driver Rewards program. We will safeguard the privacy of all non-public personal information you provide us. The personal information we collect about you comes from the following sources: Information we receive from you on applications or other forms, such as your name, address and telephone number; information about your transactions with Mobil service stations, such as transaction dates; locations; transaction amounts; and information we receive from you through the Mobil App, which may include but is not limited to your name, username, email address, password, geographic location, device address, type of device, your device's unique ID, the IP address session start and stop times, network status and information about the way you use the Mobil App, and any User Content (as that term is defined in the Mobil App Terms and Conditions).

Our Privacy Policy Is Straightforward:

Mobil and its affiliates may disclose any of the information that we collect to affiliates and nonaffiliated third parties as described below. We may disclose the information whether you are a current customer or former customer:

  • Affiliates. Mobil and affiliates are the family of companies controlled by Exxon Mobil Corporation. Our affiliates are engaged in non-financial services such as oil and gas, chemicals, and travel related services.
  • Mobil service stations in Guam or Saipan. Mobil, Mobil service stations in Guam or Saipan, other third parties who market their products or services in conjunction with Mobil, and the Financial Institution whose products or accounts you have linked to your Mobil Smiles account must have certain financial information to process your Smiles transactions and to conduct business operations with Mobil.
  • They, and other third parties, may also offer you special programs as a benefit of your Smiles Membership. Mobil may share your non-public personal information as needed for you to take advantage of these programs and so that these persons and entities may communicate with you directly about such programs. You may elect to participate in certain loyalty programs or promotions with Mobil, Mobil service stations in Guam or Saipan, or Marketing Partners that by their very nature require the sharing of your personal information. Consequently, if you request Mobil to facilitate your enrollment in a marketing or loyalty program of a Marketing Partner, your request constitutes express consent for Mobil to share your personal information with such retailer as needed to perform that service.
  • Consumer reporting agencies. We may disclose the information that we collect relating to our transactions or experiences with you to consumer reporting agencies and similar organizations.
  • Nonaffiliated Third Parties. Nonaffiliated third parties such as: Financial service providers including companies engaged in banking, mortgage banking, credit cards, consumer finance, securities, and insurance. Non-financial companies such as retailers, service providers, membership clubs, publishers, companies engaged in direct marketing and the selling of consumer products and services and other companies and organizations such as non-profit organizations, any bidder for all or part of the Smiles program, or to protect you and other Mobil Smiles users from fraud.
  • Companies that provide Mobil important services. Mobil obligates its service and marketing providers to keep your financial and personal information confidential.
  • Law Enforcement, Judicial Authorities, and Others. Mobil will share your non-public personal information as needed with appropriate law enforcement officials to investigate theft, fraud and other suspicious activity involving your Smiles account.
Mobil may share your non-public personal information with other third parties as otherwise required or as permitted by law.

Mobil May Collect Information About You When You Use the Mobil App

While using the Mobil App, Mobil may record information including, but not limited to, your geographic location, device address, type of device, your device's unique ID, the IP address session start and stop times, network status and information about the way you use the Mobil App ("device Information"). Your use of the Mobil App constitutes your consent to allow Mobil to process and record your device Information.

Mobil and its affiliated companies may retain personal information you provide for the duration of the services as long as is necessary to provide support related reporting and trend analysis. Individual transaction data will be securely stored according to Mobil’s data retention guidelines for transactional data.

Mobil Uses Your Non-Public Personal Information to Process Transactions, To Serve You Better, To Keep You Informed, and To Manage Our Business.

Mobil uses commercially reasonable security measures to protect your User Content and your account information and has security measures in place to help protect against the unauthorized access of personally identifiable information under our control. We utilize both online and offline security methods, including firewalls, passwords, and restricted physical access to the places where your information is stored to help protect personally identifiable information. Mobil protects your information in a confidential and secure database, and maintains physical, electronic and procedural safeguards to help safeguard your non-public personal information. Mobil uses your non-public personal information to process your transactions, to enhance the Mobil Smiles experience with more efficient operations, product and service offerings, and to inform you directly about the Mobil Smiles program. As a Mobil Smiles member you will receive communications from us, such as information about Smiles features, Mobil service stations, Marketing Partner offerings and special promotions and loyalty rewards.

You Control What Non-Public Personal Information Retailers, Marketing Partners and Financial Institutions Receive for Marketing Purposes. As one of your Membership benefits, Mobil service stations in Guam or Saipan, our Marketing Partners, and the Financial Institutions whose products or accounts you have linked to your Mobil Smiles account may have special programs or promotions that can be earned or enjoyed by using Smiles. Mobil may share some of your non-public personal information so that you may take advantage of these programs. Mobil requires Mobil service stations in Guam and Saipan, Marketing Partners, and Financial Institutions to keep your non-public personal information confidential and secure. However, if you prefer that we do not disclose non-public personal information about you to nonaffiliated third parties, you may opt out, that is you may direct us not to share this information by informing us either by:

Once you have indicated your preference to opt out, you don't need to reconfirm your opt out preference annually. Of course, you may notify us in the same methods noted above to change your preference at any time. If you are an existing Mobil Smiles member who opts out, please understand that you may receive marketing offers directly from third parties that were already in production prior to receipt of your opt out notice. Please note that these third parties may maintain their own customer databases and may obtain your non-public personal information independently of Mobil.

Mobil Smiles Service Providers Keep Your Non-Public Personal Information Confidential and Secure.

Our marketing and service providers are under contract to perform specific services for Mobil Smiles program, including customer service, order fulfillment, transaction processing, fraud and risk management, marketing services, data processing and analysis. We require them to keep your non- public personal information confidential and secure, and we impose restrictions on their use of your non-public personal information for only the purposes for which it was shared.

Further, no mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information as well will not be shared with any third parties.

Why It's Important to Keep Your Personal Information Current

Please tell us of any changes to your personal information, so we can keep your account active and inform you of important news and developments affecting your account, including alerting you to suspicious activity on your account. We may modify the Mobil Smiles program and this Privacy Policy at any time, and we will notify you of all material changes to it.

Definitions

"Financial Institution" or "Financial Institutions" means the following: credit card issuers (and the associations with which they are affiliated, e.g., MasterCard International) whose credit card you have linked to your Mobil Smiles account.

"Marketing Partners" means a nonaffiliated party that is not part of the family of companies controlled by Mobil's affiliate, Exxon Mobil Corporation. Without limiting the generality of the definition, Marketing Partners include service providers that assist in servicing accounts such as maintaining database information, authorizing transactions, preparing promotional materials, responding to customer inquiries, and marketing firms such as modeling companies that assist in Mobil's marketing efforts. Marketing Partners also include outside companies selected by Mobil to develop special offers for Smiles members.

"Mobil Smiles" and "Mobil Smiles program" mean Mobil's proprietary drivers reward program in either Guam or the Northern Mariana Islands pursuant to which Mobil Smiles members are allowed to earn and redeem for rewards Mobil Smiles points.

"Mobil service station" means a retail service station located in either Guam or the Northern Mariana Islands and which is authorized by Mobil to participate in the Smiles program.

"Mobil Smiles member" means an individual who has enrolled in the Mobil Smiles program for either Guam or the Northern Mariana Islands by completing an application and complying with term and conditions set forth in the application. New enrollment may take up to six weeks for processing and registration.
